Acceptance of Terms

By accessing or using the DataSpec platform, you agree to be bound by these Terms of Service. If you do not agree to these terms, do not use our services. These terms apply to all users, including visitors, registered users, and API consumers.

Description of Service

DataSpec is a data infrastructure platform that connects business software systems into a unified data layer. Our services include data integration, real-time synchronisation, API access, and related tools and documentation. We may update, modify, or discontinue features at our discretion with reasonable notice.

Account Registration

To use certain features, you must create an account with accurate and complete information. You are responsible for maintaining the confidentiality of your account credentials and for all activity that occurs under your account. You must notify us immediately of any unauthorised access. We reserve the right to suspend accounts that contain false or misleading information.

Acceptable Use

You agree not to reverse engineer, decompile, or disassemble any part of the platform. You may not attempt to overload, disrupt, or interfere with our infrastructure or other users' access. Unauthorised access to systems, data, or accounts is strictly prohibited. You may not use the platform for any unlawful purpose or in violation of any applicable regulations.

Intellectual Property

DataSpec and its licensors own all rights, title, and interest in the platform, including its software, design, documentation, and trademarks. Nothing in these terms grants you ownership of any DataSpec intellectual property. You may not use our branding or materials without prior written consent.

Data Ownership

Your data remains yours. You retain all rights to the data you submit to or process through the DataSpec platform. We process your data solely to provide and improve our services as described in our Privacy Policy. We do not claim ownership of your data and will not use it for purposes unrelated to delivering the service.

Limitation of Liability

To the maximum extent permitted by law, DataSpec shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including loss of profits, data, or business opportunities, arising from your use of the platform. Our total liability for any claim shall not exceed the amount you paid us in the twelve months preceding the claim. This limitation applies regardless of the legal theory on which the claim is based.

Termination

Either party may terminate this agreement at any time with written notice. Upon termination, we will provide a reasonable period for you to export your data. We reserve the right to suspend or terminate accounts that violate these terms without prior notice. Provisions that by their nature should survive termination will remain in effect.

Governing Law

These terms are governed by and construed in accordance with the laws of New South Wales, Australia. Any disputes arising from these terms or your use of the platform shall be subject to the exclusive jurisdiction of the courts of New South Wales, Australia.
